1. INTRODUCTION

1.3. By accessing or using any part of the Platform, you agree to be legally bound by these Terms.

2. PLATFORM OVERVIEW

2.1. Catsoterra operates a digital ecosystem supporting:

  • Animal welfare initiatives
  • Trap-Neuter-Return (TNR) programs
  • Volunteer coordination
  • Membership services
  • Partner and sponsor integration

2.2. The Platform includes:

  • Public website
  • User dashboard system
  • Membership and E-Card system
  • Volunteer management system
  • Rewards, points, and gamification features

2.3. The Company may modify or discontinue any feature at its discretion.

3. USER ACCOUNTS & CLASSIFICATIONS

3.1. Users may register for an account to access dashboard features.

3.2. Account types include:

  • Member Accounts
  • Volunteer Accounts
  • NGO Accounts
  • Corporate CSR Accounts
  • Administrator Accounts

3.3. Membership may be:

  • Paid (RM60 annually), or
  • Granted at the Company’s discretion

3.4. Users are responsible for:

  • Maintaining account security
  • Accuracy of information
  • All activity under their account

3.5. The Company may suspend or terminate accounts at its sole discretion.

4. DASHBOARD FEATURES & USER RESPONSIBILITY

4.1. The Platform provides features including:

  • QR-based digital E-Card identification
  • Public profiles and leaderboard display
  • Points, rewards, and referral systems
  • Event tracking and achievement badges
  • Access to educational resources
  • Partner discounts and offers
  • In-dashboard purchases of points or credits

4.2. Users acknowledge:

  • Public usernames and achievements may be visible
  • Data submitted must be accurate
  • Rewards and points have no monetary value unless specified

4.3. The Company reserves the right to:

  • Modify or remove features
  • Adjust rewards systems
  • Remove inappropriate content or usernames

5. USER CONTENT & PROFILE DATA

5.1. Users may upload profile images and account information.

5.2. By submitting content, you grant the Company a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for Platform operation.

5.3. Volunteers acknowledge:

  • Photos taken during activities may be used by Catsoterra
  • Such content becomes property of the Company

5.4. The Company may remove content deemed:

  • Inappropriate
  • Offensive
  • Misleading
  • In violation of these Terms

6. MEMBERSHIP & DIGITAL SERVICES

6.1. The Platform offers digital memberships (“E-Cards”).

6.2. Memberships:

  • Are valid for 12 months
  • May auto-renew annually
  • Are non-refundable

6.3. Membership benefits may include:

  • Dashboard access
  • Volunteer eligibility
  • Partner discounts
  • Rewards and gamification

6.4. Membership access may be restricted upon expiration.

7. PAYMENTS & FINANCIAL TERMS

7.1. Payments are processed via third-party providers (e.g., Stripe, PayPal).

7.2. The Company does not store full payment details.

7.3. Currency is processed in MYR; international payments may be converted.

7.4. The Company may introduce:

  • Donations (subject to regulatory approval)
  • Affiliate programs
  • Sponsored funding

7.5. All funds support operational and mission-based activities unless stated otherwise.

8. PARTNERS, SPONSORS & THIRD-PARTY BUSINESSES

8.1. The Platform may feature third-party businesses (“Partners”).

8.3. The Company does not guarantee:

  • Quality of services
  • Pricing
  • Availability

9. VOLUNTEER ACTIVITIES & REAL-WORLD RISK

9.1. The Platform facilitates volunteer coordination and TNR-related activities.

9.2. Volunteers:

  • Act independently
  • Are not employees or agents of the Company

9.3. Participation in animal-related activities involves inherent risks.

9.4. By participating, volunteers acknowledge:

  • Risk of injury
  • Risk from animals or environment
  • Personal responsibility for actions

9.5. Volunteers must sign separate waivers before participation.

9.6. The Company is not liable for:

  • Injuries
  • Damages
  • Actions taken independently by users

10. ACCEPTABLE USE

Users must not:

  • Misuse the Platform
  • Provide false information
  • Attempt unauthorized access
  • Interfere with system operations
  • Engage in harmful or illegal behavior

Violations may result in:

  • Suspension
  • Termination

11. PRIVACY & DATA

13. LIMITATION OF LIABILITY

1. INTRODUCTION

This Acceptable Use Policy (“AUP”) governs the use of the Catsoterra Berhad platform, including the website, dashboard, membership systems, and associated services (“Platform”).

By accessing or using the Platform, you agree to comply with this AUP in addition to the Website Terms & Conditions and all other applicable policies.

Failure to comply may result in warnings, suspension, termination, or legal action.

2. USER RESPONSIBILITY

2.1. Users are responsible for all activity conducted under their account.

2.2. Users must:

  • Provide accurate and truthful information
  • Maintain the security of their account
  • Comply with all applicable laws and regulations

2.3. Each account is treated as a separate user account. Users may create multiple accounts; however:

  • Each account is subject to applicable membership fees
  • Each account is independently monitored and enforced

3. ACCOUNT SECURITY & SHARING

3.1. Account sharing is strictly prohibited.

3.2. Users must not:

  • Share login credentials
  • Allow unauthorized access to their account

3.3. Any activity conducted under an account will be treated as the responsibility of the registered user.

4. USERNAMES & PROFILES

4.1. Users must register using their real identity.

4.2. Users may set a display name (“nickname”), provided that it:

  • Is not offensive
  • Does not contain hate speech
  • Does not impersonate another individual or organization
  • Does not violate any applicable law

4.3. If a display name violates this policy:

  • A warning will be issued
  • The Company may replace the display name with the User’s first name as a temporary measure

5. USER CONTENT (PROFILE IMAGES)

5.1. Users may upload profile images.

5.2. The following content is strictly prohibited:

  • NSFW or sexually explicit material
  • Violent or graphic content
  • Hate symbols or discriminatory content
  • Unauthorized commercial branding or logos (unless an approved Corporate Partner)

5.3. If content violates this policy:

  • The image will be removed or replaced with a default image
  • A warning will be issued

6. PLATFORM INTEGRITY & SYSTEM ABUSE

6.1. Users must not exploit, manipulate, or interfere with the Platform, including:

  • Bugs or system vulnerabilities
  • Points, rewards, or referral systems
  • Leaderboards or achievements

6.2. If exploitation or abuse is detected:

  • The issue will be corrected
  • Any gains (points, rewards, benefits) will be reversed

6.3. Enforcement:

  • First offense → Warning
  • Repeated offense → Account suspension or permanent ban

7. POINTS, REWARDS & REFERRAL SYSTEM

7.1. Points and rewards are non-transferable and have no monetary value unless explicitly stated.

7.2. Users must not:

  • Create accounts solely to farm points
  • Abuse referral systems
  • Manipulate rewards

7.3. The Company reserves the right to:

  • Modify, revoke, or reset points
  • Adjust leaderboard rankings
  • Remove rewards obtained through abuse

8. PARTNER, DISCOUNT & CSR BENEFIT USAGE

8.1. The Platform may provide access to partner discounts, Corporate CSR benefits, and volunteer-exclusive privileges.

8.2. Misuse of these benefits is prohibited.

8.3. Enforcement: First offense → Warning; Repeated offense → Removal of access to benefits or account suspension.

8.4. Certain benefits are restricted to verified users (e.g., volunteers). Unauthorized access or misuse may result in immediate restriction.

8.5. The Company may suspend promotions, modify access, or pause partner programs to prevent or address abuse.

9. MISREPRESENTATION & BRAND MISUSE

9.1. Users must not:

  • Misrepresent themselves as official representatives of Catsoterra
  • Impersonate volunteers, staff, or partners
  • Use Catsoterra branding without authorization

9.2. Any misuse of the Company’s name, reputation, or identity may result in:

  • Immediate account termination
  • Legal action where appropriate

10. REAL-WORLD MISUSE & CONDUCT

10.1. Users must not use the Platform to:

  • Conduct unsafe or unauthorized animal handling
  • Mislead others regarding TNR practices
  • Engage in harmful or irresponsible behavior

10.2. The Platform is not a substitute for professional guidance. Users act independently and are responsible for their actions.

11. ENFORCEMENT POLICY

11.1. The Company applies a case-by-case enforcement approach, with the following general framework:

  • First violation → Warning
  • Repeated violation → Suspension or permanent ban

11.2. Severe violations may result in immediate termination without warning, including:

  • Fraud
  • System abuse
  • Misrepresentation
  • Harmful conduct

12. ADMINISTRATIVE RIGHTS

12.1. The Company reserves full rights to remove accounts, remove or modify content, adjust or revoke points, and restrict or suspend access.

12.2. All system actions are logged and monitored.

12.3. Any abuse of administrative privileges will result in immediate revocation of access, internal action, or legal action where applicable.

13. ACCOUNT TERMINATION & CONSEQUENCES

13.1. The Company may terminate accounts without notice.

13.2. Upon termination:

  • Access to the Platform is revoked
  • Points, rewards, and benefits may be forfeited
  • Membership fees are non-refundable

14. APPEALS PROCESS

14.1. Users may submit an appeal following account suspension or termination.

14.2. Appeals will be reviewed by the Company.

14.3. Decisions will be made based on internal review and require majority administrative consensus.

14.4. Reinstatement is not guaranteed.

15. LEGAL ACTION

15.1. The Company reserves the right to pursue legal action in cases involving:

  • Fraud
  • Defamation
  • Libel
  • Misuse of brand or identity

16. MODIFICATIONS

16.1. This AUP may be updated at any time.

CATSOTERRA BERHAD — REFUND POLICY

1. INTRODUCTION

This Refund Policy (“Policy”) applies to all digital membership products (“E-Cards”), subscriptions, and related services offered by Catsoterra Berhad, a Company Limited by Guarantee incorporated in Malaysia (“the Company”, “we”, “us”, or “our”).

By purchasing an E-Card or using our membership services, you (“User”, “you”, or “your”) agree to the terms set forth in this Policy.

Digital membership products are considered delivered immediately upon purchase and are governed by the rules below.

2. NON-REFUNDABLE DIGITAL PRODUCTS

2.1. All E-Card purchases, membership fees, and digital subscriptions are strictly non-refundable.

This includes, without limitation:

  • Digital E-Card memberships
  • Auto-renewed membership terms
  • Membership upgrades
  • Early cancellations
  • Accidental purchases
  • Duplicate purchases
  • Failure to use or access the membership

2.2. Digital memberships are considered “delivered” upon:

  • Issuance of confirmation email
  • Activation of the membership record
  • Delivery of any digital benefits, dashboard access, or system registration

Once delivered, they cannot be reversed or refunded.

3. AUTO-RENEWAL POLICY

3.1. All E-Card memberships renew automatically on an annual basis unless canceled according to our procedures.

3.2. During checkout, Users must tick a mandatory checkbox acknowledging:

  • Auto-renewal
  • Non-refundability
  • Cancellation requirements
  • Data retention policy

Auto-renewal will not occur unless this checkbox is selected.

3.3. Renewal reminders will be issued:

  • 60 days before renewal
  • 30 days before renewal

The User is solely responsible for monitoring renewal notices.

4. CANCELLATION POLICY

4.1. Users may cancel their membership any time before the renewal date by following the instructions provided in renewal reminder emails.

4.2. If the User fails to cancel before renewal, the next term’s payment will be processed automatically and is non-refundable.

4.3. Cancelling a membership:

  • Does not entitle the User to a refund of any portion of the current membership term.
  • Prevents future renewal charges only.

4.4. Upon cancellation, the User’s account will enter soft freeze for two (2) years, during which:

  • Limited membership data is retained
  • No charges occur
  • Reactivation is possible without full re-registration

5. FAILED PAYMENTS & BILLING ISSUES

5.1. If an auto-renewal payment fails:

  • We may reattempt the charge using updated or stored payment credentials
  • The User will be notified via email

5.2. Membership benefits may be suspended until payment is successful.

5.3. Failed or disputed payments do not create eligibility for refunds.

6. PAYMENT PROCESSOR RESPONSIBILITY

6.1. Payments are processed through secure, PCI-compliant third-party processors such as:

  • PayPal
  • Other authorized processors (local or international)

6.2. The Company does not directly store full credit card information; processors store encrypted/tokenized credentials.

6.3. Refund requests made to the payment processor instead of the Company will be rejected based on this Policy.

7. EXCEPTIONS (EXTREMELY LIMITED)

Refunds will not be issued under any circumstances except where required by Malaysian law.

7.1. Legal exceptions may include:

  • Duplicate charges caused solely by system error
  • Fraud proven to be unrelated to the User’s device, account, or negligence
  • Billing errors directly caused by the Company

7.2. In such cases, the Company reserves the right to investigate before issuing any remedy.

7.3. Voluntary goodwill refunds will not be offered.

8. NO REFUNDS FOR:

  • • Change of mind
  • • Failure to use membership benefits
  • • Delayed access due to User device or email issues
  • • Incorrect information during purchase
  • • User misunderstanding of benefits or terms
  • • Inability to volunteer or attend events
  • • Loss of access due to policy violations
  • • Auto-renewals not canceled in time

9. DATA RETENTION AFTER CANCELLATION

9.1. Membership and billing data will remain in soft freeze for two (2) years following cancellation.

9.2. After two years, all Personal Data and payment information will be permanently and irreversibly deleted, consistent with PDPA and our Privacy Policy.

9.3. Deleted accounts cannot be restored.
